Patriot Home Cleaning - Terms of Service

These Terms are important and affect your legal rights. Please carefully read these Terms of Service prior to engaging Patriot Home Cleaning.
Section 1 – Introduction & Consent to Terms.
Welcome to the Terms of Service for Wisniewski Consulting LLC d/b/a Patriot Home Cleaning, a Connecticut limited liability company, referred to herein as “Patriot Home Cleaning,” “we,” “us,” or “our.” These Terms of Service are referred to herein as our “Terms.” Thank you for choosing Patriot Home Cleaning for your residential cleaning and related home service needs. These Terms set forth the terms and obligations between us, the company providing the Services, and you, our client. Your use of our residential cleaning, deep cleaning, move-in/move-out cleaning, and other services agreed to in writing, collectively referred to as our “Services,” constitutes explicit acceptance of these Terms.
Section 2 – Exploring Our Services & Initial Consultation
If you think Patriot Home Cleaning might be a good fit for your needs, please contact us to receive a quote or estimate for your proposed service. All quotes and estimates are based on the information available at the time, including the requested services, property condition, size, access, frequency, and estimated scope of work. While we do our best to provide accurate pricing, the final cost may change if the actual scope of work is larger than represented, if additional services are requested, if the property condition requires additional time or labor, or if circumstances outside our control affect the work. Before charging you for any material increase in the quoted price, we will notify you of the increase and obtain your approval before moving forward with the additional work. Any approved increases, if applicable, will be invoiced to you at the end of the service or project.
Section 3 – Performance of Services
Services.
Patriot Home Cleaning agrees to perform the Services listed in your quote, estimate, booking, work order, or other written confirmation. If one or more services you need are not listed, it is your responsibility to request that they be added before work begins. Our pricing is based on the Services listed in the quote, estimate, booking, work order, or written confirmation.
Workers.
All work provided by Patriot Home Cleaning will be performed by one or more of our employees, contractors, agents, or other authorized workers. When you hire Patriot Home Cleaning to provide the Services, you are hiring Patriot Home Cleaning and not any individual employee, contractor, agent, or worker.
Timing.
All arrival times, departure times, and service durations are estimates only. While we do our best to arrive on time and complete work within the estimated timeframe, we cannot guarantee an exact arrival time, departure time, or completion time.
Delays.
Delays, access issues, weather, traffic, job conditions, staffing changes, or other circumstances may require rescheduling or adjustment. If a delay or scheduling issue occurs, we will attempt to communicate with you as soon as reasonably possible.
Worker Assignments.
We reserve the right to assign, replace, or change the person or persons performing the Services. Any change in the person or persons performing the Services will not entitle you to a reduction in price, cancellation, refund, or pause in service. If you request a specific person to perform the Services, we will do our best to accommodate the request but cannot guarantee availability.
Access.
You agree to provide Patriot Home Cleaning with safe and reasonable access to the home, property, or other location where the Services will be performed. Any inability to perform the Services because of lack of access, unsafe conditions, locked doors, pets, parking restrictions, utilities not being available, or other access-related issues will be your responsibility.
Review.
We recommend, but do not require, that you are available before and after the Services so you can review the work and notify us of any concerns. If you are not present at the conclusion of the Services, the Services will be deemed completed when we leave the property, subject to any applicable satisfaction guarantee or written issue-reporting period stated in these Terms.
Compliance.
At all times, Patriot Home Cleaning shall act in accordance with applicable laws, rules, and regulations in performing the Services.
Section 4 – Terms of Purchase
Quotes are provided free of charge unless otherwise stated. Quotes expire after thirty (30) days unless a different expiration date is stated in writing. We may offer one or more of the following service pricing options:
Flat Fee Services.
We may offer Services based on a flat-fee agreement for the proposed work. The flat fee will depend on the nature of the work, property condition, service type, estimated time, number of workers required, frequency, and other relevant factors. The flat fee is subject to change if the scope, condition, access, or requested Services change, as described in Section 2.
Hourly Services.
We may offer Services based on the amount of time spent performing the Services. Hourly Services will be provided at the hourly rate stated in your quote, estimate, booking, or written confirmation. Unless otherwise stated, time may be billed in fifteen (15) minute increments.
Recurring Cleaning Services.
We may offer recurring cleaning services on a weekly, biweekly, monthly, or other agreed schedule. Recurring Cleaning Service inclusions, pricing, and frequency will vary depending on your property, needs, service plan, customization, and other relevant factors.
Each Recurring Cleaning Service plan will continue until cancelled by you or Patriot Home Cleaning in accordance with these Terms. You will be charged according to the plan, frequency, and payment terms you select or approve. Each Recurring Cleaning Service is subject to the cancellation, refund, and satisfaction guarantee provisions in these Terms.
Section 5 – Deposit
If required, you agree to pay Patriot Home Cleaning an initial deposit to reserve the selected service date, time, workers, or project schedule. The deposit amount, if any, will be determined by Patriot Home Cleaning based on the anticipated scope of work, service type, scheduling requirements, property condition, difficulty, and other relevant factors. If a deposit is required, the deposit must be paid before the service date, project, or recurring service is confirmed. You understand and agree that Patriot Home Cleaning is not obligated to reserve or hold any service date, time, workers, or project schedule until the required deposit is paid. Subject to the Cancellation, Refunds, and Satisfaction Guarantee section below, deposits are non-refundable and will be applied to the total balance owed. No interest will accrue on any deposit.
Section 6 – Payment, Billing, and Other Charges
Prices.
All prices for the Services are in U.S. dollars. We accept forms of payment approved by Patriot Home Cleaning, which may include Zelle, credit card, debit card, electronic payment, or other approved payment methods.
Pricing Changes.
We reserve the right to change our Services, pricing, packages, fees, or Recurring Cleaning Service plans at any time. If we change the amount or other charges associated with your recurring Services, we will provide at least thirty (30) days’ advance written notice before the change takes effect.
Service Rights.
We reserve the right to refuse service to anyone to the extent permitted by law and to discontinue certain Services at any time.
Payment Information.
When you provide payment information, you represent and warrant that the information you provide is accurate, that you are authorized to use the payment method provided, and that you will notify us of any changes to the payment information.
Payment Authorization.
By providing a credit card, debit card, or other payment method, you authorize Patriot Home Cleaning, or our third-party payment processor, to charge your payment method for all charges you incur for the Services, including applicable taxes, fees, deposits, recurring service charges, approved additional work, late cancellation fees, and other amounts owed under these Terms.
Electronic Communications and Signatures. You agree that Patriot Home Cleaning may communicate with you by email, text message (SMS), telephone, Jobber, QUO, or other electronic means regarding estimates, scheduling, reminders, invoices, payments, service updates, and customer support. You further agree that electronic approvals, bookings, estimates, invoices, work orders, and electronic signatures shall have the same force and effect as original handwritten signatures to the fullest extent permitted by applicable law.
Failed Payments.
If your payment is denied, declined, reversed, or otherwise not completed, you remain responsible for the full amount owed. Patriot Home Cleaning may charge a reasonable administrative fee of fifty dollars ($50.00) for declined payments, returned payments, or failed payment attempts to help cover administrative costs, follow-up, and processing time.
Recurring Service.
Failure to maintain a valid payment method does not constitute cancellation of a Recurring Cleaning Service. Your Recurring Cleaning Service will continue until cancelled in accordance with these Terms or suspended or terminated by Patriot Home Cleaning.
Recurring Charges.
If you have enrolled in Recurring Cleaning Service, you expressly acknowledge and agree that Patriot Home Cleaning, or our third-party payment processor, is authorized to charge you on the agreed recurring basis for the price of your Recurring Cleaning Service, including applicable taxes and fees, for as long as your Recurring Cleaning Service continues.
Customer Charges.
You are responsible for all charges related to untimely cancellations, missed appointments, lockouts, lack of access, approved additional work, and unpaid invoices.
Cancellation and Access Fees.
Patriot Home Cleaning may charge a reasonable cancellation, lockout, no-access, or trip fee if we are unable to perform the Services due to late cancellation, locked doors, lack of access, unsafe conditions, undisclosed hazards, unavailable utilities, unsecured pets, or other conditions outside our control after workers have been assigned or dispatched.
Invoices.
All invoices are due and payable within forty-eight (48) hours of receipt unless otherwise stated in writing.
Late Payments.
Failure to pay an invoice in full within forty-eight (48) hours of receipt may cause the unpaid balance to accrue interest at three percent (3%) per month, or the maximum amount permitted by law, whichever is less, until paid in full.
Collections.
Once an invoice becomes thirty (30) days past due, Patriot Home Cleaning may transfer the invoice, account, and any past-due amounts to a collection agency or attorney. If your invoice, account, or past-due amount is transferred for collection, Patriot Home Cleaning shall be entitled to recover the unpaid balance, collection costs, chargeback fees, court costs, and reasonable attorneys’ fees to the extent permitted by law.
Chargebacks.
We do not permit improper chargebacks. If you dispute a charge, you agree to contact Patriot Home Cleaning first so we can attempt to resolve the issue. If a chargeback is initiated improperly or in bad faith, Patriot Home Cleaning reserves the right to recover the original amount owed, any chargeback fees assessed by the payment processor, collection costs, and reasonable attorneys’ fees to the extent permitted by law.
Section 7 – Warranties of Services Performed
Patriot Home Cleaning represents that the Services will be performed in a professional manner consistent with reasonable industry standards for residential cleaning and related home services. Except as expressly stated in these Terms, Patriot Home Cleaning makes no other warranties, representations, or guarantees regarding the Services, including any guarantee that every stain, mark, odor, buildup, condition, or issue can be fully removed or corrected. Patriot Home Cleaning will maintain commercially reasonable insurance coverage appropriate for the Services it provides. Nothing in these Terms shall expand Patriot Home Cleaning’s liability beyond the coverage, exclusions, limitations, and terms of any applicable insurance policy or these Terms.
Section 8 – Cancellation, Refunds, and Our Satisfaction Guarantee
All cancellations or changes to the date or time of our Services must be made at least 48 hours before your scheduled start time. If you cancel or reschedule within 48 hours of your scheduled start time, Patriot Home Cleaning may retain your deposit, charge a cancellation fee, or apply your deposit to a future booking, at Patriot Home Cleaning’s discretion. You may cancel your Recurring Cleaning Service at any time by contacting Patriot Home Cleaning through our website, by phone at (860) 864-4449, or through any approved scheduling or customer communication platform.
Except as expressly stated in these Terms or required by law, payments, deposits, and completed transactions are non-refundable.
We offer a satisfaction guarantee for Services we perform. If you are dissatisfied with the Services, you must notify Patriot Home Cleaning in writing within forty-eight (48) hours after completion of the Services and provide us a reasonable opportunity to inspect, address, re-clean, or correct the issue. If you do not notify us within forty-eight (48) hours or do not provide us a reasonable opportunity to address the issue, you will not be entitled to Our Satisfaction Guarantee. Our Satisfaction Guarantee applies only to the specific Services performed and does not apply to conditions outside the agreed scope of work, pre-existing conditions, permanent stains, damage, excessive buildup, unsafe conditions, items or areas we were instructed not to clean, or issues caused after we leave the property.
Section 9 – Workplace Protections
Ensuring that our workers are safe while performing the Services is of utmost importance to Patriot Home Cleaning. We reserve the right to refuse, stop, or reschedule any Service if we determine, in our reasonable discretion, that the work may create a health, safety, legal, or operational risk. Unless specifically agreed to in writing, we do not perform the following work:
- Cleaning beyond what is safely reachable using a three-step ladder;
- Cleaning of biohazard substances, bodily fluids, animal waste, human waste, blood, or other hazardous materials;
- Cleaning of areas infested with insects, rodents, or other pests;
- Cleaning areas with mold, suspected mold, toxins, hazardous chemicals, or unsafe air quality;
- Moving excessively heavy items or performing tasks requiring specialized equipment;
- Handling weapons, illegal items, controlled substances, medical waste, or dangerous materials;
- Performing repairs, remediation, pest control, medical cleaning, or hazardous-material cleanup;
- Performing any task that could jeopardize the health, safety, or legal compliance of our workers, customers, business, or others.
Undisclosed Pest Infestation Policy
If a pest or bug infestation, including but not limited to bed bugs, roaches, fleas, termites, rodents, or similar conditions, is not disclosed before our arrival, Patriot Home Cleaning reserves the right to refuse service, stop work, reschedule the service, and/or charge reasonable fees for time, travel, cancellation, contamination risk, or other costs incurred. Failure to disclose an infestation before your scheduled service will be considered a violation of these Terms due to the health, safety, and contamination risks it may pose to our workers, customers, equipment, vehicles, and other clients.
Section 10 – Limitations of Engagement
While Patriot Home Cleaning strives to provide a high standard of quality when performing the Services, there are limitations to our engagement, including but not limited to the following:
Pets.
It is your responsibility to ensure that all pets are secured, controlled, and cared for before and during the Services. Patriot Home Cleaning does not assume responsibility for the health, safety, behavior, escape, injury, or illness of any pet, except to the extent caused by our gross negligence or willful misconduct.
For example, if a pet enters a work area, interferes with the Services, escapes through an opened door, or consumes a cleaning product or other substance while we are working, Patriot Home Cleaning will not be responsible unless caused by our gross negligence or willful misconduct.
Personal Property.
It is your responsibility to ensure that all personal property, valuables, fragile items, heirlooms, collectibles, irreplaceable items, cash, jewelry, important documents, electronics, and items with sentimental or high monetary value are removed from the cleaning area or specifically identified to us before work begins. It is also your responsibility to inform Patriot Home Cleaning of any item, surface, material, finish, fixture, or personal property that requires special care, should not be cleaned, or may be damaged by ordinary cleaning products, equipment, moisture, movement, or contact. Patriot Home Cleaning does not assume responsibility for damage to personal property, surfaces, finishes, or items caused by pre-existing conditions, improper installation, age, wear and tear, manufacturer defects, fragile condition, undisclosed special-care requirements, or customer failure to remove or identify items before the Services begin. For example, if a specialized finish on furniture, flooring, countertops, fixtures, or décor reacts poorly to standard cleaning methods or products and we were not advised of the special-care requirement before work began, Patriot Home Cleaning will not be responsible unless caused by our gross negligence or willful misconduct.
Fixtures and Home Conditions.
It is your responsibility to ensure that fixtures, blinds, shelves, towel bars, shower doors, cabinet hardware, appliances, décor, and other items in the home are properly installed, stable, and in good working condition. Patriot Home Cleaning does not assume responsibility for damage to fixtures, décor, or household items that are loose, unstable, improperly installed, defective, deteriorated, previously damaged, or not in good working order. For example, if blinds, shelving, hardware, or other fixtures fall, break, loosen, or detach during ordinary cleaning because they were unstable, worn, defective, or improperly installed, Patriot Home Cleaning will not be responsible unless caused by our gross negligence or willful misconduct.
Section 11 – Reviews and Satisfaction Resolution
If you are happy with our Services, we appreciate reviews on the platform of your choosing. Reviews help potential clients understand our work and help us grow our business. If you are dissatisfied with our Services, please contact us within forty-eight (48) hours so we have an opportunity to address your concern under Our Satisfaction Guarantee. Nothing in these Terms is intended to prevent you from posting an honest review or providing truthful feedback about your experience. Patriot Home Cleaning reserves all rights and remedies available under applicable law regarding false statements, fraud, harassment, threats, or defamatory statements.
Section 12 – No Solicitation of Workers
By hiring Patriot Home Cleaning, you agree not to directly or indirectly solicit, hire, engage, or encourage any person employed, contracted, referred, assigned, or introduced by Patriot Home Cleaning to provide services to you outside of Patriot Home Cleaning without our prior written consent. This restriction applies during the time Patriot Home Cleaning provides Services to you and for twelve (12) months after the last date Patriot Home Cleaning provides Services to you. We require this because Patriot Home Cleaning invests time, money, and effort into recruiting, screening, training, managing, scheduling, and supervising its workers and service providers. If you violate this section, Patriot Home Cleaning reserves the right to pursue all remedies available under applicable law, including recovery of damages, lost business, costs, and reasonable attorneys’ fees to the extent permitted by law.
Section 13 – Photographs for Promotional Purposes
Patriot Home Cleaning may take photographs of the work performed for quality control, documentation, marketing, advertising, and promotional purposes, including use on Patriot Home Cleaning’s website and/or social media accounts. This may include before-and-after photos. You will not be entitled to any royalty, payment, or other compensation for any permitted use of such photographs. Nothing in these Terms requires Patriot Home Cleaning to use any photographs taken before, during, or after your service. Patriot Home Cleaning will not intentionally include personally identifying information, family photos, addresses, minors, private documents, security codes, financial information, medical information, or other sensitive personal information in promotional photographs without additional permission. Clients may notify us before service if they do not want photos taken for promotional use.
Section 14 – Patriot Home Cleaning Intellectual Property
The contents of our website are protected by United States and international copyright laws. The contents of our website are owned by Patriot Home Cleaning or licensed to us. You may not, and may not cause or encourage others to, reproduce, distribute, display, sell, transfer, assign, license, or use for commercial purposes any copyrighted material on our website without our prior written consent. All rights not expressly granted in these Terms are reserved to Patriot Home Cleaning. Patriot Home Cleaning, our name, logos, slogans, designs, graphics, and related branding are trademarks, service marks, or protected brand assets of Patriot Home Cleaning. You may not use any Patriot Home Cleaning name, mark, logo, slogan, graphic, or other brand asset without our prior written consent.
Section 15 – Disclaimer
Our Services are provided “as is” and, to the extent permitted by applicable law or as expressly included in these Terms, Patriot Home Cleaning and its directors, officers, owners, employees, contractors, agents, and representatives disclaim all representations or warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, satisfactory quality, and fitness for a particular purpose. While we endeavor to provide the best Services possible, you acknowledge and agree that no cleaning or related home service is perfect, and that results may vary based on property condition, materials, surfaces, access, pre-existing conditions, staining, damage, buildup, or other factors outside our control. If you are unhappy with the Services provided, please contact us and we will do our best to resolve the issue in accordance with our Satisfaction Guarantee.
Section 16 – Limitation of Liability
Patriot Home Cleaning shall not be liable for delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to weather, traffic, illness, staffing issues, access issues, unsafe conditions, utility outages, emergencies, acts of God, or other events outside our control. To the extent permitted by applicable law, Patriot Home Cleaning shall not be liable to you for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of use, loss of business, or loss of data, even if we were advised of the possibility of such damages. To the extent permitted by applicable law, Patriot Home Cleaning’s total liability to you for all damages, losses, and causes of action arising out of or related to the Services or these Terms shall not exceed the total amount you paid to Patriot Home Cleaning for the Services giving rise to the claim. You agree that no claim or action in contract, warranty, or tort, including negligence, arising out of or related to the Services or these Terms may be brought more than one (1) year after the cause of action relating to such claim arose, to the extent permitted by law.
Section 17 – Indemnification
Each party shall indemnify, defend, and hold harmless the other party and its directors, officers, owners, managers, employees, contractors, agents, and representatives from and against any and all losses, damages, liabilities, reasonable attorneys’ fees, court costs, and expenses resulting from claims, actions, proceedings, or litigation arising from that party’s breach of these Terms, violation of applicable law, negligence, willful misconduct, or misuse of the Services.
Section 18 – General Provisions
a. Entire Agreement.
These Terms contain the entire agreement between you and Patriot Home Cleaning regarding the Services, except for any additional terms, service details, pricing, or inclusions stated in a quote, estimate, booking, work order, invoice, or other written confirmation.
The failure by Patriot Home Cleaning to enforce any provision of these Terms shall not be construed as a waiver or limitation of our right to subsequently enforce and compel strict compliance with that provision or any other provision of these Terms.
c. Assignment.
You may not assign, pledge, delegate, or otherwise transfer any of your rights or obligations under these Terms without Patriot Home Cleaning’s prior written consent.
d. Relationship.
Nothing in these Terms creates, or is intended to create, an agency, employment, franchise, joint venture, or partnership relationship between you and Patriot Home Cleaning. Patriot Home Cleaning is responsible for managing its own workers, contractors, taxes, and business operations.
e. Applicable Law / Dispute Resolution.
These Terms shall be governed by the laws of the State of Connecticut. The parties agree to first attempt to resolve any dispute in good faith through direct communication. If the dispute cannot be resolved informally, the parties agree to participate in mediation in Connecticut, unless both parties agree otherwise in writing. If mediation does not resolve the dispute, either party may pursue any available legal remedies in a court of competent jurisdiction in Connecticut, including small claims court where applicable. Nothing in this section prevents Patriot Home Cleaning from pursuing collection of unpaid invoices or other amounts owed. The prevailing party in any dispute arising out of these Terms shall be entitled to recover its reasonable attorneys’ fees and costs to the extent permitted by law.
f. Waiver of Class Action.
To the extent permitted by applicable law, you and Patriot Home Cleaning agree that any dispute arising out of these Terms or the Services is personal to you and Patriot Home Cleaning and will be brought only on an individual basis, not as a class action or other representative proceeding.
g. Severability.
If any provision of these Terms is held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
